This Privacy Notice applies to Beeworks Food Sdn Bhd and Golden Beeworks Sdn Bhd including their respective subsidiaries and affiliates (collectively, the "Company", "we", "us", or "our").

Your personal data privacy is important to us and we are highly committed in respecting and managing your personal data collected in line with this Privacy Notice. This Privacy Notice is developed pursuant to the Personal Data Protection Act 2010 which sets out, inter alia, the collection, use and disclosure of your personal data.

Consent to the collection and processing of your personal data

The Company will not collect or process your personal data without your consent, except where permitted or authorised by the applicable laws. Where applicable, we will obtain your express consent to collect your personal data when you perform any of the activities as set out in the section titled “When and what kind of personal data do we collect?” For instance, you may be asked to fill in a form, tick a box, and click a button to indicate your consent to be bound by the terms and conditions of this Privacy Notice. In addition, you consent to our collection and processing of your personal data when you visit or continue to browse on this website (hereinafter referred to as “Jollibee Malaysia’s website”). Any form of consent given by you, whether express or implied, is subject to this Privacy Notice, under which you agree that we may collect and process your personal data in accordance with its terms.

In this regard, please note that it is your responsibility to ensure that all personal data submitted to us is complete, accurate, true, correct and up-to-date at the time of submission.  Failure to do so may result in our inability to fulfil certain contractual obligations with you or to provide you with certain products or services.

Please note that if you do not consent to this Privacy Notice, The Company may also be unable to fulfil certain contractual obligations with you or to provide you with certain products or services.

The Company shall not be liable for any damage, claim and/or harm suffered by you as a result of your failure to provide or update us with your complete, accurate, true, correct and up-to-date personal data.

When and what kind of personal data do we collect?

The Company collects personal data that you knowingly and voluntarily provide to us when you:

  1. provide personal data by filling in forms on the Jollibee Malaysia’s website, social media platforms, at our restaurants, pop-up restaurants or events, or by giving feedback, making inquiries, submitting requests or providing other types of submissions;

  2. engage with us through Jollibee Malaysia’s website, social media platforms, email, SMS and phone call;

  3. enter into any contract with the Company, purchase any products, or seek for services from us;

  4. participate in any marketing and promotional activities, market surveys and analytics organised by us;

  5. visit our restaurants, pop-up restaurants or events;

  6. participate in any of our contests, competitions, or prize draws; or

7.  seek employment with us.

Your data is any information about you that may be used to identify you. It includes the information that you provide to us, that we collect, or that we are provided with by third parties who act for you, whether directly or indirectly. It does not include anonymous data whereby the identity has been removed so that it can no longer be associated with you. The Company may collect, process, use, store, and transfer the following kinds of personal data through the channels mentioned above to the extent permissible under the applicable laws and regulations:

  1. Name;

  2. Particulars of ID/Passport;

  3. Date of Birth;

  4. Mailing and residential addresses;

  5. Email addresses;

  6. Telephone numbers;

  7. Gender;

  8. Photographs and CCTV Recordings of you;

  9. Transaction information, such as product purchased, price, method of payment and payment details

  10. Any other personal information you may voluntarily provide during your interactions with us (including through Jollibee Malaysia’s website, social media platforms, email, SMS and phone call).

  11. If you are applying for employment with us, we may collect relevant information such as your income details, employment history and references, tax information, EPF and SOCSO records, banking and credit card details, as well as sensitive personal data including information on your physical or mental health, religious beliefs, criminal record, and any other information necessary for the purposes of evaluating your application.

Where specified, providing your personal information is mandatory for us to process your participation in the activities mentioned above. If you choose not to provide the required information, we may be unable to proceed with your request.

For what purposes do we use your personal data?

The Company processes your data based on your consent, our legitimate interests, our legal obligations, and the necessity to fulfil our contractual obligations to you.

We may use the personal information collected from you for one or more of the following purposes:

  1. To fulfil our obligations arising from any contracts entered into between you and us (i.e. purchase and delivery of our products and services including payment processing);

  2. To enable our subcontractors, third-party agents and service providers, to fulfil obligations as stipulated in your contract with us;

  3. To provide customer support, respond to, and communicate with you about our  products, your services requests and enquiries (including payments for products and services);

  4. To administer and update your records in our databases, and to monitor and maintain a copy of your previous transaction records;

  5. To facilitate the delivery, maintenance and enhancement of our products, services, projects, programmes, activities and events;

  6. To plan, monitor and enhance the provision of new products, services, projects, programmes, activities and events;

  7. To improve our customer service through your feedback and provide recommendations;

  18. To take emergency measures to secure the safety of our customers, our personnel, or the public; and

  19. Purposes incidental to each or all of the above.

We may use the information we collect about you for other purposes, as specifically disclosed to you at the time of collection.

We may also contact you by any means of communication for which you have given us contact details, including but not limited to via email, phone call, SMS, and post, for the purpose of getting your feedback or for providing you with information which we believe could be of interest to you or your organisation.

How we share your personal data?

By your submission of your personal data to us, you consent to the onward disclosure of some or all of your personal data to the following parties in connection with the purposes described in this Privacy Notice:

  1. any member within the Company group, including its subsidiaries, affiliates, and ultimate holding company.

  2. third-party service providers (such as subcontractors, agents and network operators). The entities to whom we disclose your personal data may be located in various countries.

  3. Strategic or marketing partners that we cooperate with.

  4.  Facebook, TikTok, Instagram or any social media platforms that we may use from time to time (if you use your account with them to sign up/in with us), if applicable.

  5. any person or entity to whom we are required or requested to make such disclosure by any court of competent jurisdiction or by any governmental, taxation, or other regulatory authority, law enforcement agency, or similar body.

  6. buyers or other parties involved in a corporate transaction, in the event we decide to sell or transfer all or part of our business for strategic or other business reasons; and

  7. our professional advisers such as our legal representatives, consultants, bankers, auditors and insurance brokers.

Note that your sensitive personal data (e.g. physical or mental health, religious beliefs, criminal record) will not be shared or disclosed to any entity unless where you have provided your express written consent.

To maintain the confidentiality and integrity of your personal data, we will only share your data on a need-to-know basis.

Children’s Privacy

If you are under 16 years of age, you may browse Jollibee Malaysia’s website. However, you may not provide personal information to us. Jollibee Malaysia’s website’s is not designed for persons under the age of 16 and we do not knowingly collect personal information from anyone under the age of 16.

As a parent or legal guardian, please do not allow minors under your care to submit personal data to us. If such personal data of a minor is disclosed to us, you hereby consent to the processing of the minor’s personal data, and agree to be bound by this Privacy Notice and take responsibility for his or her actions.

Location and transfer of personal data

The Company may collect and process your personal data in countries other than your country of residence or the country from which you provided us with your personal data. These other countries may not have the same data protection laws as the country in which you reside or provided personal data. Where there is a need to transfer your personal data to other countries for the purposes described in this Privacy Notice, we will ensure the transfer is accorded with similar levels of data protection as those in your country. 

How long do we retain your personal data?

The Company retains your personal data for as long as necessary to fulfil the purposes for which it was collected as outlined in this Privacy Notice, to meet our business or legal obligations, to resolve disputes, or to troubleshoot issues, or as otherwise required or permitted by applicable laws. After that timeframe, the Company will delete your personal data or keep it in a form that does not permit identifying you. In addition, certain information may be stored indefinitely due to technical constraints and will be blocked from further processing for purposes that are not mandatory by law.

If you choose to unsubscribe from our mailing list, we may still retain your personal data in our database to the extent permitted by the applicable laws.

How do we protect your personal data?

The personal data that we hold about you will be secured and stored on our servers.  The Company implements appropriate technical and organisational security measures to protect your submitted information from loss, destruction, unauthorised access, use, modification, disclosure or similar risks. All electronic storage and transmission of personal data is secured and stored on managed servers with controlled access and appropriate security technologies. When we engage third parties to process personal data on our behalf, we will ensure they provide sufficient guarantees to us to have implemented the necessary organisational, information security, and technical measures, and have taken reasonable steps to comply with these measures. Although every reasonable effort has been made to ensure that all personal data is  protected, no data transmission over the internet can be guaranteed as fully secure. We cannot guarantee that the security measures that we have in place to safeguard personal data will never be defeated or fail, or that those measures will always be efficient or effective. The Company cannot be held responsible for any unauthorised use or misuse of such information, or for risks that are inherent in all internet communications.

The Company shall not sell your personal data and only share your information as described in this Privacy Notice or as otherwise communicated to you at the time we collect your information.

Links to third party websites and Non-Company Operated Outlets

Jollibee Malaysia’s website may contain links to third-party websites and services, such as our business partners, that are not controlled or operated by the Company (collectively, “Third Party Sites”) even though some of these sites may display our logo or trademark. In addition, there may be outlets carrying the Jollibee brand that are not owned or operated by the Company (collectively, “Non-Company Operated Outlets”). We are not responsible for the privacy notices and the data collection practices of all Third Party Sites and/or Non-Company Operated Outlets. We strongly encourage you to check the privacy notice of each Third Party Sites and/or Non-Company Operated Outlets that you visit or engage with. Please contact the owner of the respective websites and/or Non-Company Operated Outlets should you have any questions on their privacy notices. Your use of these Third Party Sites and/or any transactions with Non-Company Operated Outlets are entirely at your own risk and the Company does not accept any responsibility or liability for the privacy practices of these Third Party Sites and/or Non-Company Operated Outlets.
